Terms & Conditions

These Terms and Conditions govern the relationship between Permata Estates (β€œwe”, β€œus”, β€œour”) and any individual or entity (β€œGuest”, β€œyou”) who makes an enquiry, enters into a rental agreement, or uses our website. By proceeding with an enquiry or signing a rental agreement, you indicate that you have read and agree to these terms. These terms are governed by the laws of Malaysia, and the courts of Melaka shall have jurisdiction over any disputes.

1. Definitions

  • "Service" β€” the provision of curated heritage property rentals and associated hospitality arrangements by Permata Estates.
  • "Property" β€” any of the three heritage residences managed by Permata Estates: the Melaka Courtyard House, Riverside Heritage Estate, or Straits Settlement Mansion.
  • "Rental Agreement" β€” the formal signed contract governing an individual stay, incorporating these Terms and Conditions by reference.
  • "Stay Period" β€” the dates specified in a confirmed Rental Agreement during which a Guest has exclusive use of a Property.
  • "Host" β€” the Permata Estates representative assigned to manage a Guest's stay.

2. Acceptance of Terms

A binding agreement is formed when a Guest signs a Rental Agreement issued by Permata Estates. Submitting an enquiry form does not constitute a booking or reservation. All persons entering into a Rental Agreement must be 18 years of age or older and have the legal capacity to enter into contracts under Malaysian law. By signing, you confirm that you meet these requirements.

3. Property Availability and Booking

Properties are offered subject to availability and are confirmed only upon receipt of a signed Rental Agreement and the required deposit. Permata Estates reserves the right to decline any enquiry without obligation to state reasons. Availability is not guaranteed until written confirmation is issued. Geographic access to our properties is subject to any applicable travel or entry requirements in force at the time of the stay.

4. Payment Terms

All prices are quoted and payable in Malaysian Ringgit (MYR) unless otherwise agreed in writing. Payment is structured as follows:

  • A deposit of 30% of the total rental fee is due upon signing to confirm the booking
  • The remaining balance is due 14 days before the commencement of the Stay Period
  • For stays confirmed with less than 14 days' notice, full payment is required at signing
  • Payment may be made by bank transfer to the nominated account stated in the Rental Agreement

Late payment may result in the reservation being released. Quoted rates include utilities, Wi-Fi, and baseline hospitality services as described in the property listing. Supplementary services are charged separately as agreed.

5. Cancellation and Refund Policy

Cancellations must be communicated in writing to [email protected]. The following terms apply:

  • Cancellation more than 60 days before the Start Date: deposit refundable less a 10% administrative fee
  • Cancellation 30–59 days before the Start Date: 50% of total rental fee forfeited
  • Cancellation fewer than 30 days before the Start Date: full rental fee forfeited
  • In the event of force majeure, terms will be negotiated in good faith on a case-by-case basis

6. Guest Responsibilities

Guests are responsible for the proper use and care of the Property during the Stay Period. The following obligations apply:

  • The Property shall be used for private residential purposes only, unless prior written permission is granted for events or commercial use
  • Guests shall not exceed the maximum occupancy stated in the Rental Agreement
  • No structural modifications, nail holes, or permanent fixtures shall be made to heritage fabric
  • Pets are not permitted without prior written consent
  • Smoking is prohibited inside all Properties
  • Guests shall treat all staff, hosts, and neighbours with courtesy and respect
  • Any damage caused during the Stay Period shall be reported immediately and may be charged to the Guest

7. Intellectual Property

All content on the Permata Estates website β€” including text, photographs, and design elements β€” is the property of Permata Estates and may not be reproduced without written permission. Guests may photograph and share images of their stay for personal, non-commercial purposes and are welcome to tag us. Commercial reproduction of property images requires separate written agreement.

8. Heritage Property Conditions

Our properties are heritage-listed buildings with historical characteristics that differ from modern construction. Guests accept that certain features β€” including uneven surfaces, original woodwork, natural ventilation, and period fittings β€” are intrinsic to the properties. These characteristics are not defects and do not constitute grounds for complaint or refund. All properties are maintained to a high standard of safety and cleanliness consistent with their heritage status.

9. Disclaimers

Permata Estates makes no guarantee of specific outcomes, experiences, or conditions during a stay, including weather, local events, or the availability of third-party services. Our website and communications describe typical conditions and experiences but are not contractual promises. Information on the website is provided in good faith and may be updated without notice.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Permata Estates shall not be liable for any indirect, incidental, or consequential loss arising from a Guest's stay or use of our website. Our total liability in any circumstances shall not exceed the total rental fee paid for the relevant stay. Nothing in these terms limits liability for death, personal injury, or fraud caused by our negligence.

11. Termination

Permata Estates reserves the right to terminate a Rental Agreement and require immediate vacation of the Property if a Guest materially breaches these Terms. In such cases, no refund will be payable. Grounds for termination include, but are not limited to, exceeding occupancy limits, causing damage, or creating a nuisance to neighbours. Guests may terminate a rental in accordance with the cancellation terms in Clause 5.

12. Dispute Resolution

In the event of a dispute, we encourage Guests to contact us in writing at [email protected] to seek informal resolution before pursuing formal proceedings. If informal resolution is not achievable within 30 days, disputes shall be subject to the jurisdiction of the courts of Melaka, Malaysia. These terms are governed by Malaysian law.

13. General Provisions

These Terms, together with the Rental Agreement, constitute the entire agreement between Permata Estates and the Guest. If any provision is found to be unenforceable, the remaining provisions continue in full force. Failure by Permata Estates to enforce any provision does not constitute a waiver. These terms may not be assigned by the Guest without written consent.

14. Changes to These Terms

We may update these Terms from time to time. The version in force at the time a Rental Agreement is signed shall govern that agreement. Updated Terms are posted on this page with a revised effective date.
